Terms & Conditions

General terms of service for JimTime under Italian Legislative Decree 70/2003 and the Consumer Code (Legislative Decree 206/2005).

1. Preamble and acceptance

These Terms & Conditions (the "Terms") govern the use of the JimTime platform and related services (the "Service"), provided by JimTime, VAT IT01069920146, registered office at Via Bona Lombarda 15a, 23017 Morbegno (SO), Italy (the "Provider", "we").

Accessing the Service, registering an account or using any of its features implies full and unconditional acceptance of these Terms. If you do not accept them, you are not allowed to use the Service.

2. Definitions

"User": natural or legal person using the Service, either as a professional (gym, personal trainer, coach, nutritionist) or as an athlete.

"Account": the User's personal area, created via registration and protected by credentials.

"Plan": the service level purchased by the User (free, Premium for athletes, Jim Choice/Flex/Custom for professionals).

"Content": data, files, training plans, nutrition plans, photos, communications and any other material uploaded or generated by the User within the Service.

3. Subject of the agreement

The Service is a SaaS platform for the management of gyms, training sessions, courses, attendance, subscriptions, nutrition plans and communication between professionals and athletes, accessible via web and through mobile apps (iOS, Android, WearOS).

The Provider reserves the right to modify, integrate or suspend individual Service features at any time, giving registered Users prior notice with reasonable lead time for substantial changes.

4. Account and registration

Most features require Account registration with true, complete and up-to-date data. The User is responsible for safeguarding the credentials and for every activity carried out via the Account.

Only adults with full legal capacity may register. Professionals operating as company or sole proprietorship must hold a VAT number or a duly registered business.

The Provider may refuse registration or suspend an Account in case of breach of these Terms or suspected fraudulent use.

5. Plans, prices and payments

Plans and prices are published on the /pricing page of the JimTime website and may be amended by the Provider with at least 30 days' notice for existing subscribers.

Payments are processed exclusively through Stripe Inc. JimTime does not store credit-card data on its servers.

Paid subscriptions automatically renew at the end of the selected period (monthly or annual), unless cancelled by the User at least 24 hours before the renewal date from the personal area.

All prices are VAT included. Professional Users will receive an electronic invoice via SDI.

6. Free trial and right of withdrawal

The Provider may offer free trial periods of the duration stated in promotions. At the end of the trial, unless cancelled, the subscription will automatically activate on the selected plan.

Right of withdrawal (consumer Users only, art. 52 of Italian Legislative Decree 206/2005): if the User acts as a consumer (natural person acting outside their professional activity), they have the right to withdraw from the contract within 14 days of conclusion without any penalty.

The User acknowledges that, by activating the Service immediately upon registration, they expressly waive the right of withdrawal once Service performance has been completed (art. 59 letter o, Legislative Decree 206/2005), as is typical for digital services.

7. User obligations

The User agrees to use the Service in compliance with the law, public order and decency, and not to:

a) Upload illegal, defamatory, obscene content, content that infringes others' privacy or third-party rights.

b) Use the Service for commercial purposes other than those provided by the subscribed Plan.

c) Attempt to access other Users' data or compromise Service integrity (DoS attacks, reverse engineering, mass scraping).

d) Share credentials or allow unauthorized third parties to use the Account.

The Provider may immediately remove infringing Content and suspend the Account, without prejudice to damage claims.

8. User-uploaded content

The User retains ownership of their Content. By uploading Content to the Service, the User grants the Provider a non-exclusive, royalty-free, revocable license to host, process and display it for the sole purpose of providing the Service.

Upon Account cancellation, Content can be exported on request within 30 days of termination, after which it will be permanently deleted subject to legal retention obligations.

9. Intellectual property

The JimTime software, its logos, trademarks, interfaces, source code, design and any graphic or textual element owned by the Provider are protected by copyright and industrial-property laws. Any reproduction, modification, distribution or reverse engineering without written authorization is forbidden.

10. Limitation of liability

The Provider makes the Service available with maximum technical diligence but does not guarantee absolute absence of interruptions, errors or malfunctions.

To the extent permitted by law, the Provider is not liable for indirect damages, loss of profit, loss of data or business interruption arising from use or inability to use the Service. The Provider's total liability shall in no case exceed the amount paid by the User in the 12 months preceding the damaging event.

The above does not limit the Provider's liability for willful misconduct or gross negligence, nor the mandatory consumer protections under the Italian Consumer Code.

11. Suspension and termination

The User may terminate the contract at any time by deactivating the Account from the personal area or by request via email.

The Provider may suspend or terminate the contract, even without notice, in case of serious breach of these Terms, non-payment, illegal use or fraud.

12. Changes to the Terms

The Provider reserves the right to modify these Terms at any time. Changes will be communicated by email to registered Users with at least 30 days' notice and published on this page. Continued use of the Service after the changes take effect constitutes acceptance.

13. Privacy

Personal data processing is governed by the Privacy Policy available at the /privacy URL of the JimTime website, which forms an integral part of these Terms.

14. Governing law and jurisdiction

These Terms are governed by Italian law.

Disputes arising from the execution of the contract shall fall under the exclusive jurisdiction of the Court of Sondrio (Italy), unless the User acts as a consumer, in which case the mandatory consumer forum (place of residence or domicile of the consumer) applies.

15. Alternative dispute resolution (ODR)

Under EU Regulation 524/2013, consumer Users may resort to the European ODR (Online Dispute Resolution) platform at https://ec.europa.eu/consumers/odr/ to extra-judicially resolve disputes arising from contracts concluded online.
